习近平总书记海洋权益思想的法律体系实证建构与发展路径研究

摘要: 在海洋大发展时代与海洋强国战略推进背景下,海洋权益成为国家发展核心议题之一,习近平总书记海洋权益思想为新时代我国海洋事业发展与权益维护提供了根本遵循。本文立足我国海洋权益思想历史演进脉络阐释习近平总书记海洋权益思想的核心要义,分析该思想指导下法律体系构建现实逻辑,明确法律体系在海洋权益里多方面的实践价值,提出兼具针对性与可操作性的体系构建路径。研究表明构建以习近平总书记海洋权益思想为核心的法律体系是海洋领域全面依法治国的制度要求,能够为海洋强国建设筑牢法治屏障,推动海洋治理现代化与海洋命运共同体构建,助力我国在全球海洋治理中占据主动地位。

Title: Empirical Construction and Development Paths of the Legal System Based on General Secretary Xi Jinping's Thinking on Maritime Rights and Interests

Abstract: Against the backdrop of the era of great marine development and the advancement of the strategy to build China into a strong maritime nation, maritime rights and interests have emerged as one of the core issues in national development. General Secretary Xi Jinping's thinking on maritime rights and interests provides the fundamental guideline for advancing China's marine endeavors and safeguarding its maritime rights and interests in the new era. This paper, based on the historical evolution of China's thinking on maritime rights and interests, expounds on the core essence of General Secretary Xi Jinping's thinking on maritime rights and interests, analyzes the realistic logic behind the construction of a legal system under the guidance of this thinking, clarifies the practical value of such a legal system in various aspects of maritime rights and interests protection, and proposes targeted and operable approaches to its development. The research shows that establishing a legal system centered on General Secretary Xi Jinping's thinking on maritime rights and interests is a systemic requirement for comprehensively promoting law-based governance in the marine sector, which can consolidate the legal safeguards for building a strong maritime nation, advance the modernization of marine governance and the development of a maritime community with a shared future, and help China take an active position in global maritime governance.
